This website is operated by HAJEX INC., operating as HAJEX Fitness (“HAJEX”, “we”, “us” or “our”). We offer this website, including all information, tools and services available from it (the “Service”), on the condition that you accept these Terms of Service (the “Terms”) and the policies they refer to.

By visiting our site or buying from us, you agree to these Terms and to our Shipping Policy, Refund & Returns Policy and Privacy Policy. These Terms apply to everyone who uses the site, including browsers, customers, vendors and contributors of content. If you do not agree to them, please do not use the site.

Our store runs on the Shopify e-commerce platform. Calls and messages with HAJEX may be recorded for quality, training and record-keeping purposes.

1. Online Store Terms

By agreeing to these Terms, you confirm that you are at least the age of majority in your province or state of residence, or that you are the age of majority and have given consent for your minor dependents to use this site.

You may not use our products or the Service for any illegal or unauthorized purpose, or in violation of any law in your jurisdiction, including copyright laws. You must not transmit worms, viruses or any code of a destructive nature. A breach of these Terms may result in the immediate termination of your access to the Service.

2. General Conditions

We may refuse service to anyone, at any time, for any lawful reason.

Your content (not including payment card information) may be transferred unencrypted over various networks and adapted to the technical requirements of connecting networks or devices. Payment card information is always encrypted during transfer.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website, without our express written permission. The headings in these Terms are for convenience only and do not limit or affect them.

3. Accuracy of Information

We work to keep the information on this site accurate and current, but it is provided for general information and may occasionally contain errors or outdated content (see section 11). This site may contain historical information, which is provided for reference only. We may change the content of this site at any time.

4. Changes to the Service and Prices

Prices and products are subject to change without notice. The price that applies to your order is the price shown at checkout when you place it.

We may modify or discontinue the Service, or any part of it, at any time. We are not liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

5. Products

Some products may be available only online and in limited quantities. Returns, exchanges and warranty claims are handled under our Refund & Returns Policy. Shipping, duties and delivery terms are set out in our Shipping Policy.

We make every effort to display product colours and images accurately, but we cannot guarantee that your screen shows colours accurately. Finishes, logos and packaging can vary between production batches, as explained in our Refund & Returns Policy.

We may limit the sale of products to any person, region or jurisdiction, and may limit the quantities we offer, on a case-by-case basis. Product descriptions and prices may change at any time, and we may discontinue any product at any time. Any offer made on this site is void where prohibited.

6. Orders, Billing and Account Information

We may refuse or cancel any order, and may limit quantities purchased per person, household or order, including orders placed under the same customer account, payment card, or billing or shipping address. We may also limit or refuse orders that appear to be placed by dealers, resellers or distributors. If we change or cancel an order, we will try to contact you using the email address or phone number provided with the order. If we cancel an order, you receive a full refund to your original payment method.

You agree to provide current, complete and accurate purchase and account information, and to update it promptly, including your email address and payment card details, so that we can complete your transactions and contact you as needed. We may ask for identity or address verification before shipping, as described in our Shipping Policy.

7. Optional Tools

We may give you access to third-party tools that we do not monitor or control. These tools are provided “as is” and “as available”, without any warranty or endorsement from us, and your use of them is at your own risk and subject to the terms of their providers. Any new features or services we add to the website are also subject to these Terms.

Some content, products and services available through our site may include materials from third parties, and some links may take you to websites we do not control. We are not responsible for third-party materials or websites, or for transactions you make with third parties. If you send us comments, ideas, suggestions, reviews or other materials (“comments”), whether at our request or not, you agree that we may edit, copy, publish, distribute, translate and otherwise use them in any medium, with no obligation to keep them confidential, to pay for them or to respond to them.

We may, but are not required to, monitor, edit or remove content that we consider unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes anyone’s intellectual property or these Terms.

You agree that your comments will not infringe anyone’s rights, including copyright, trademark, privacy or personality rights, and will not contain unlawful, abusive or obscene material or any malicious code. You may not use a false email address, pretend to be someone else, or mislead us or others about the origin of your comments. You are responsible for the comments you make and for their accuracy.

11. Errors, Inaccuracies and Omissions

Our site may occasionally contain typographical errors, inaccuracies or omissions in product descriptions, pricing, promotions, shipping charges, transit times or availability. We may correct them and update information at any time.

If an error affects an order you have already placed, we will contact you before the order ships. You may then continue at the corrected terms, or cancel and receive a full refund to your original payment method. This does not limit your rights under applicable consumer protection laws.

12. Prohibited Uses

In addition to the other restrictions in these Terms, you may not use the site or its content: (a) for any unlawful purpose; (b) to solicit others to take part in unlawful acts; (c) to violate any international, federal, provincial or state law or regulation; (d) to infringe our intellectual property rights or those of others; (e) to harass, abuse, insult, harm, defame, intimidate or discriminate against anyone based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or get around the security features of the site. We may end your use of the site for violating any of these prohibited uses.

13. Warranties and Limitation of Liability

Our products are covered by the 12-month warranty against manufacturing defects described in our Refund & Returns Policy, in addition to any warranties that apply under consumer protection law.

We do not guarantee that the website will be uninterrupted, timely, secure or error-free, and we may take it offline from time to time. Apart from the warranty above and the rights you have under applicable law, the website is provided “as is” and “as available”.

To the extent permitted by law, HAJEX and its directors, officers, employees, affiliates, agents, contractors, suppliers and service providers are not liable for any indirect, incidental, special, punitive or consequential damages, including lost profits, lost revenue, lost savings or loss of data, arising from your use of the website or of any product bought through it.

Nothing in these Terms excludes or limits our liability for bodily or moral injury, for our own intentional or gross fault, or for anything else that cannot be excluded or limited under the law that applies to you.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless HAJEX and its affiliates, partners, directors, officers, employees, agents, contractors, licensors, service providers, subcontractors and suppliers from any claim or demand, including reasonable legal fees, made by a third party because of your breach of these Terms or of the documents they refer to, or your violation of any law or of the rights of a third party.

15. Severability

If any part of these Terms is found to be unlawful, void or unenforceable, that part will still apply to the fullest extent the law allows, and any unenforceable portion will be treated as removed without affecting the rest of these Terms.

16. Termination

These Terms remain in effect until they are ended by you or by us. You may end them at any time by telling us you no longer wish to use the Service, or by no longer using our site. If we believe you have breached these Terms, we may end them at any time and deny you access to the Service; you remain responsible for any amounts owed up to that date. Obligations incurred before termination survive it.

17. Entire Agreement

Our failure to enforce any right or provision of these Terms is not a waiver of it. These Terms, together with the policies posted on this site, form the entire agreement between you and us about the Service and replace any earlier agreements or versions of these Terms.

18. Governing Law

These Terms, and any separate agreements under which we provide services to you, are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. Nothing in these Terms limits the rights you have under the consumer protection laws of the province, state or country where you live.

You can review the current version of these Terms on this page at any time. We may update them by posting the changes on our website and changing the date at the top. Changes do not apply to orders placed before they were posted. By continuing to use the site after changes are posted, you accept them.
