HAJEX INC., operating as HAJEX Fitness (“HAJEX”, “we”, “us”), sells fitness equipment through hajex.com and ships from our warehouses in Anjou, Quebec and Delta, British Columbia. This policy explains what personal information we collect, why we use it, who we share it with, how long we keep it, and the choices and rights you have.

It applies when you visit hajex.com, buy from us, contact us, or buy one of our products through a partner store that passes the order to us for delivery.

1. Who Is Responsible for Your Information

2. Information We Collect

2.1 Information you give us

  • Contact details: name, email address, phone number, billing and delivery address.
  • Order details: the products you buy, prices, delivery instructions, and any return, refund or warranty request, including photos or videos you send us.
  • Account details: if you create an account, your login details, order history and saved addresses.
  • Messages: emails, calls, chat messages and product reviews.
  • Marketing choices: whether you agreed to receive our emails or text messages.
  • Identity verification: when your billing and delivery addresses differ, or an order is flagged for fraud review, we may ask for photo ID showing your name and address. You may cover your date of birth, ID number and photo.

2.2 Payment information

Card and bank details are handled by our payment processors, including Shopify Payments, and by any financing provider you choose at checkout, such as Affirm. We do not store full card numbers. We receive confirmation of your payment and the results of fraud checks, such as whether your address and security code matched.

2.3 Information collected automatically

When you use our website or open our emails, we and our partners collect device and browser information, your IP address and approximate location, the pages and products you view, what you add to your cart, how you arrived at our site, and how you interact with our emails. We collect this with cookies, pixels and similar technologies (see section 5).

2.4 Information from others

  • Partner stores that sell our products and pass the order to us for delivery.
  • Carriers, which tell us about delivery status and proof of delivery.
  • Advertising and social media platforms, when you interact with our ads or pages.
  • Payment and fraud-prevention services, as described above.

3. How We Use Your Information

  • To process, deliver and support your order, including pickups, local delivery, returns, refunds and warranty claims.
  • To calculate shipping and taxes and, for US orders, to prepare customs documents.
  • To prevent fraud and protect you and us, including verifying orders and responding to payment disputes.
  • To answer your questions and keep you informed about your order.
  • To send you marketing emails and text messages, if you agreed to receive them.
  • To measure and improve our advertising and to show you relevant ads on other websites and apps.
  • To improve our website, products and service.
  • To meet our legal obligations, such as tax, accounting and customs rules, and to establish or defend legal claims.

We use your information only for these purposes, for other purposes you agree to, or as the law allows.

4. Who We Share Your Information With

We do not sell your personal information for money. We share it only as needed with:

  • Shopify, which hosts our store, and the apps that help us run it, such as tools for reviews, email and text messages, and customer support.
  • Payment processors, financing providers and fraud-prevention services.
  • Carriers, freight companies and customs brokers. For US orders, your name, address, phone number and order contents are given to US customs, as the law requires for imports.
  • Our staff, delivery drivers and contractors who help with customer support, software and marketing, all bound to keep your information confidential.
  • Partner stores that sold you one of our products, so they can follow up on your order.
  • Advertising and analytics partners, such as Google, Meta (Facebook and Instagram), TikTok and Snapchat, through cookies and pixels on our website.
  • Professional advisers, such as accountants, lawyers and insurers, and authorities when the law requires it or to protect rights, safety or property.
  • A buyer or successor, if our business is sold or reorganized. Your information would stay protected by this policy.

5. Cookies and Advertising

We and our partners use cookies, pixels and similar technologies to keep the store working (cart, checkout and login), remember your preferences, measure how the site performs, and show you relevant ads on other websites and apps.

You can control cookies through your browser settings and, where we show one, our cookie banner. Blocking some cookies may stop parts of the store from working, and it may not stop all sharing with advertising partners.

We use Shopify’s advertising services, such as Shopify Audiences. To limit their use of your information, visit privacy.shopify.com. Where the law requires it, we treat a Global Privacy Control signal from your browser as a request to opt out of targeted advertising for that browser.

6. Where Your Information Is Stored and Processed

We are based in Canada. Our service providers, including Shopify, and some of our staff and contractors store or access personal information outside Quebec and outside Canada, including in the United States and other countries. Information handled outside Canada may be subject to the laws of those countries. We use contracts and security measures to protect it wherever it is handled.

7. How Long We Keep Your Information

  • Orders, invoices and payment records: at least six years after the end of the tax year they relate to, as Canadian tax law requires.
  • Identity verification documents: only as long as needed to verify the order and handle any payment dispute, then deleted.
  • Warranty claims and support messages: as long as needed to resolve the matter and for the rest of the warranty period.
  • Marketing information: until you unsubscribe or ask us to delete it.
  • Account information: until you close your account or ask us to delete it, except for records we must keep.

When we no longer need personal information, we delete it or make it anonymous.

8. How We Protect Your Information

Access to personal information is limited to people who need it for their work. Payments are handled by certified payment providers, and our store runs on Shopify’s secure platform. No system is completely secure. If a privacy incident creates a risk of serious harm, we will notify you and the authorities as the law requires.

Please send ID documents only by the method we ask you to use, and never send full card numbers by email.

9. Your Rights and Choices

Depending on where you live, you can:

  • Ask what personal information we hold about you, how we use it and who we share it with;
  • Ask us to correct information that is inaccurate or incomplete;
  • Withdraw your consent, subject to legal or contractual limits;
  • Ask us to delete your information, or to stop sharing or indexing it, where the law allows;
  • Ask for a copy of the information you gave us in a structured, commonly used format;
  • Opt out of marketing emails at any time with the unsubscribe link, or of text messages by replying STOP;
  • Opt out of targeted advertising and, where US state privacy laws apply, of the “sale” or “sharing” of personal information as those laws define it.

To make a request, contact the person in charge listed in section 1. We respond within 30 days. We may ask you to confirm your identity first, and we will ask an authorized agent for proof that they can act for you. We will not treat you differently for exercising your rights.

10. Children

Our store is not intended for children, and we do not knowingly collect personal information from anyone under 16. If you believe a child has given us personal information, contact us and we will delete it.

11. Reviews and Public Content

Reviews and other content you post on our website are public. Anyone can see them, and we cannot control how others use information you choose to make public.

12. Links to Other Websites

Our website links to websites and platforms run by others, such as social media and payment providers. Their own privacy policies apply when you use them.

13. Complaints

If you have a concern about how we handle your personal information, please contact the person in charge listed in section 1 first. If you are not satisfied with our answer, you can contact the Commission d’accès à l’information du Québec (if you live in Quebec), the Office of the Privacy Commissioner of Canada, or the privacy authority where you live.

14. Changes to This Policy

We may update this policy from time to time. We will post the new version on this page and change the date at the top. If a change significantly affects how we use your personal information, we will let you know.
